(“Evolve”, “we”, “us” or “our”) collects, uses, processes, and discloses your information, including personal information, that we collect from visitors to the Evolve website, including any subdomains thereof, and any other websites through which Evolve makes its services and information about its services available on any type of device (collectively, the “Website”). This Privacy Policy also describes what choices you have in managing your personal information. This Privacy Policy is designed to provide consumers (“you” or “your”), who use our Website and services, with tools to help understand and control the collection, use, and disclosure of that personal information.

Directly From You. We may collect some personal information directly from you by asking that you provide it to us. For instance, when you register on the Website, join Evolve as a home owner, join Evolve’s partner network, or book travel online.
Through our Use of Cookies and Other Automatic Data Collection Technologies. We may collect your personal information when you visit our Websites, use our mobile applications, open or click on emails we send you, or interact with our advertisements. We or third parties we work with automatically collect certain information using technologies such as cookies, web beacons, clear GIF, pixels, internet tags, web server logs, and other data collection tools. Geo-Location Technologies. We may collect information about the location of your device, if you provide your consent. You may request at any time that we do not collect information about your location by contacting us at the address listed below under the Section titled “Contact Information.”
Social Networking Sites. If you log into your user account through shared sign-in services (e.g., Facebook Connect), you provide Evolve with permission to access certain information about you from that social networking site, such as your user profile, friend list, and profile picture.
Third Party Data Sources. We may receive marketing information from third parties, such as our vendors, commercial partners, data providers, and data partners (“Data Sources”). We allow Data Sources to send us marketing information that they have collected from both online and offline sources. This may include information from customer lists, website memberships, or other information created from a third-party’s own technology (such as proprietary modeling or matching technology of other companies).

To Whom We Disclose Your Personal Information

Within Evolve. We may disclose your personal information with our corporate affiliates (e.g., parent company, sister companies or subsidiaries, and other companies under common control) or joint ventures to which we are a party.
Service Providers. We may disclose information with third-party service providers in order for those service providers to perform business functions for Evolve, and help us to fulfill our and/or our home owner’s contractual obligations on a booking transaction (e.g., arranging housekeeping services). Service Providers also help us to create or maintain our databases, research and analyze the people who request products, services or information from us, to prepare and distribute communications, or to respond to inquiries.
Law Enforcement and Legal Process. We may report to law enforcement agencies any activities that we reasonably believe to be unlawful, or that we reasonably believe may aid a law enforcement investigation into unlawful activity, as well as disclose your information to the extent required by a valid order of a court or other governmental body or by applicable law. In addition, we reserve the right to release your information to law enforcement agencies if we determine, in our sole judgment, that either you have violated our policies, or the release of your information may protect the rights, property, or safety of Evolve, or another person.
Sharing Your Information as Permitted by Law. We may disclose your information with others as required by, or permitted by, law. This may include sharing your information with governmental entities, or third parties in response to subpoenas, court orders, other legal process, or as we believe is necessary to exercise our legal rights, to defend against legal claims that have been brought against us, or to defend against possible legal claims that we determine in our sole discretion might be brought against us.
Business Transition. In the event that we, or any portion of our assets, are acquired or we undergo another transition in our business, your information may be transferred to the acquiring company or other entity surviving such a transition.
Advertising Companies. We may participate in behavioral-based advertising. This means that a third party may use technology, such as a cookie or a web beacon, to identify you on the Website so that they can provide advertising about products and services tailored to your interest. That advertising may appear either on the Website or on other websites. You may have the right to opt out of our use of these technologies, as further described in this Privacy Policy.
Partner Companies. We may disclose your personal information with carefully selected outside companies when we believe their products or services may interest you. This does not include mobile information or text messaging opt-in data or consent, which we never share for these purposes. Mobile Information and Text Messaging. Notwithstanding anything else in this Privacy Policy, no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. We do not sell, rent, or share your mobile phone number, text messaging (SMS) opt-in data, or consent with any third parties, except with service providers that help us operate our text messaging program (such as messaging platforms and wireless carriers), solely to deliver that program, or as required by law.
How We Protect Your Personal Information
Evolve has implemented physical, technological, and organizational safeguards and security measures designed to protect against the loss, misuse, or unauthorized access or disclosure of your personal information under our control. We also take measures to protect the personal information we disclose to third parties, for example by entering into contractual agreements stipulating the confidentiality of the information and the purposes for which it is to be used. Please be aware, though, that despite our efforts, no security measures are perfect or impenetrable.
You can help us by protecting and keeping your passwords safe at all times, and not using the same password for different applications or sites. You also can protect yourself and help us reduce the risk of fraud by promptly notifying us if you suspect that your credit card, bank account, user name, or password is lost, stolen, or used without permission.
How Long We Retain Your Information
We retain information about you and your use of our services for as long as is needed to fulfill our legitimate business purposes outlined in this Privacy Policy. The specific periods for which we keep information about you vary depending on the nature of the information, why we need it, and whether the personal information is de-identified. We also consider the minimum necessary retention period prescribed by applicable laws, recommended by industry standards, and stated in contracts and other legal obligations.
We use cookies and similar tracking technologies, including pixel tags or web beacons (collectively “cookies”), to collect certain information on our Websites, through our services. We also permit certain third parties to use cookies and similar tracking technologies to collect information about your use of our Websites or Services. We differentiate between cookies that are essential for the technical features of the services and optional analytics and advertising cookies:
Essential Cookies. These are cookies that the Services need in order to function, and that enable you to move around and use the Services and features. Without these essential cookies, the Services will not perform as smoothly for you as we would like them to and we may not be able to provide the Services or certain services or features you request. Examples of where these cookies are used include to determine when you are signed in, to determine when your account has been inactive, and for other troubleshooting and security purposes.
Analytics Cookies. Analytics cookies allow us to understand more about how many visitors we have to our Services, how many times they visit us, and how many times a user viewed specific pages within our Services. Although analytics cookies allow us to gather specific information about the pages that you visit and whether you have visited our Services multiple times, we cannot use them to find out details such as your name or address. Advertising Cookies. Depending on your location and in certain circumstances, Evolve may work with third‑party online or mobile network advertisers that use cookies to help us manage advertising and measure its effectiveness. These cookies enable third-party ad networks to recognize a unique cookie on your computer or mobile device and may be placed by us or our network advertising firm that works with our third-party network advertiser. The information that is collected and shared by cookies may be linked to the device identifier of the device you are using to allow us to keep track of all the sites and mobile applications you have visited that are associated with the ad network. This information may be used for the purpose of targeting advertisements on the Evolve services and third‑party sites or mobile applications based on those interests.
Your Choices
You may be able to make the following choices regarding your personal information:
Promotional Emails. You may choose to provide us with your email address for the purpose of allowing us to send free newsletters, surveys, offers, and other promotional materials to you, as well as targeted offers from third parties. You can stop receiving promotional emails by following the unsubscribe instructions in emails that you receive. If you decide not to receive promotional emails, we may still send you service-related communications.
Text Messages and Calls. You can opt out of text messages from Evolve at any time by replying STOP to any message, and you can reply HELP for help. You can ask us to stop calling you at any time during a call, or by contacting us at opt-out@evolve.com.
Data Subject Rights
You may have certain rights regarding your personal information. The rights available to you depend on our reason for processing your personal information and the requirements under applicable law (i.e., your rights will vary depending on whether you are located in, for example, California). Specifically, you may have the following rights:
Access: You have the right to request access to the personal information we hold about you, along with other information such as the Processing Purposes, the recipients or categories of recipients to whom the personal information has been or will be disclosed, the sources of the personal information, retention, and transfers of personal information.
Correction: You have the right to request correction of inaccurate personal information we have about you. Depending on the purposes of the processing, you may have the right to have incomplete personal information completed, including by means of providing a supplementary statement. You may also be able to correct your information in your account or profile.
Deletion: You have the right to request that we delete your personal information.
Data Portability: Under certain circumstances, you have the right to receive the personal information that we hold about you, in a structured, commonly used, and machine-readable format.
Opt Out of the “Sale” or “Sharing” of Personal Information
Our use of cookies or other tracking technologies is deemed a “sale” or “sharing” under California law (in this context, “sharing” means cross-contextual behavioral advertising) of personal information. As such, you can opt out of our use of tracking technologies and cookies by clicking the “Do not Sell or Share My Personal Information” button at the bottom of the Evolve Website.
Right of Non-Discrimination/Retaliation: We do not discriminate against individuals who exercise any of their rights described in this Privacy Policy, nor do we retaliate against individuals who exercise these rights.
Right to Opt Out of our Use of your Sensitive Personal Information (in certain instances and if permissible under applicable law): You have the right to request the restriction of processing of your sensitive personal information. However, at this time we do not disclose sensitive personal information for purposes other than those which cannot be limited under applicable law.
Please note that many of the above rights are subject to exceptions and limitations. Your rights and our responses will vary based on the circumstances of the request. If you choose to assert any of these rights under applicable law, we will respond within the time period prescribed by such law. In some cases, we may limit or deny your requests to access or delete your information. This may occur because the law permits or requires us to do so, or if we are unable to adequately verify your identity.
Please note that we must be able to verify your identity to make sure you are the person about whom we have collected personal information or an authorized representative. Depending on the type of request, we may conduct the verification process by email or phone using information that matches our records. The information you must provide as part of the verification process may include: name, contact information (such as email address or phone number), relationship with us, and residency. We may also ask for additional information as needed based on your relationship with us.

Evolve generally recognizes commercially recognized opt-out preference signals (e.g., Global Privacy Controls). Recognition of this signal applies only to the specific device and/or browser that communicates the signal and does not cross over to all devices/browsers you use to access the services.
Miscellaneous
Accounts. If you limit your privacy settings on an account that you hold jointly with someone else, your privacy choices will apply to everyone on your account.
Children. We do not intentionally collect information from, and do not tailor any marketing efforts to, children under 18 years of age.
Third Party Sites. The Website, our emails, or our application may link to third parties’ websites. It is also possible that third parties’ websites or emails may link to the Website. We are not responsible for the content or the privacy practices employed by third parties, and information collected by third parties is not governed by this Privacy Policy. International Operations. Evolve is based, and the Website is hosted, in the United States of America. If you are from a country outside of the United States of America with laws governing data collection, use, and sharing that may differ from U.S. law and you provide personal information with us, please note that any personal information that you provide to Evolve may be transferred to the United States of America. By providing your personal information, you hereby specifically and expressly consent to such transfer and processing and the collection, use, and sharing set forth in this Privacy Policy or in any terms of use related to the use of and access to the Website.
Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes to our practices, technology, legal requirements, and other factors. When changes are made to this Privacy Policy, they will become effective immediately upon posting. You can check the date at the top of this page to see when this Privacy Policy was last revised.
